PopSockets, a well-known American digital accessory brand, has filed a federal TRO (Temporary Responsibility Order) lawsuit with an international legal services firm, covering all platforms including Amazon, Temu, SHEIN, and eBay, targeting sellers of counterfeit phone airbag stands. The brand holds four federally registered trademarks in the United States, including wordmarks and trademarks for its 3D product designs, which are also protected under trademark law.
According to case data, over 1200 sellers are involved. These sellers only replicated the same stand design and used the keyword "PopSockets" in product titles to attract traffic, without obtaining any brand authorization. After the court issued the injunction, the platforms uniformly froze the stores' payment accounts. Settlement amounts ranged from $3,000 to $8,000 per store. Sellers who refused to respond were directly sentenced in absentia, with all funds in their accounts being deducted to compensate the brand. All counterfeit inventory was destroyed.
Cross-border intellectual property lawyers advise that in the European and American markets, the shapes and packaging of three-dimensional products can be registered as trademarks, not just word logos. Sellers of small 3C products often overlook the risk of infringement of three-dimensional trademarks.
