世界知识产权组织(WIPO)仲裁与调解中心就 Jack Wolfskin 狼爪户外品牌域名侵权案作出仲裁裁决,判令恶意抢注者将jackwolfskin2013online.com电商域名无偿转移至品牌方,关停依托该域名搭建的独立仿冒户外装备电商网站。
案件申请人为德国户外品牌 Jack Wolfskin,持有全球多区域 “狼爪” 文字、图形注册商标,品牌户外服饰、装备全球热销。第三方自然人未经许可,注册包含完整品牌名称的域名,搭建独立线上商城,网站首页、商品页面大量使用狼爪注册商标,售卖低价仿冒冲锋衣、登山鞋,依靠域名自带品牌关键词获取搜索流量牟利。
WIPO 仲裁庭认定三大恶意事实:域名完整复刻权利人注册商标,抢注者无任何品牌授权、无相关合法经营资质;搭建电商网站售卖侵权商品,以混淆消费者、赚取不当利润为唯一目的;抢注者无法对域名注册行为作出合理解释。
依据全球统一域名争议解决规则,仲裁庭作出终局裁决,强制转移涉案域名,要求侵权方立即关停仿冒电商网站,删除所有狼爪商标相关宣传素材。WIPO 同步提示全球品牌方,包含注册商标的独立电商域名属于高频侵权载体,可通过国际仲裁快速维权,无需跨多国法院诉讼。
The World Intellectual Property Organization (WIPO) Arbitration and Mediation Center has issued an arbitration award in the Jack Wolfskin outdoor brand domain name infringement case, ordering the malicious registrant to transfer the e-commerce domain name jackwolfskin2013online.com to the brand owner free of charge and to shut down the independent counterfeit outdoor gear e-commerce website built on that domain.
The applicant in the case is the German outdoor brand Jack Wolfskin, which holds registered trademarks for the "Wolfskin" word and graphic design in multiple regions worldwide. Its outdoor apparel and equipment are best-sellers globally. A third-party individual, without permission, registered a domain name containing the full brand name, built an independent online store, and extensively used the Jack Wolfskin registered trademark on the website's homepage and product pages, selling low-priced counterfeit outdoor jackets and hiking boots, profiting from search traffic generated by the domain's inherent brand keywords.
The WIPO Arbitration Tribunal found three main malicious acts: the domain name completely replicates the registered trademark of the rights holder; the registrant has no brand authorization or relevant legal business qualifications; the e-commerce website was built to sell infringing goods, with the sole purpose of confusing consumers and earning illicit profits; and the registrant could not provide a reasonable explanation for the domain name registration.
Based on the globally unified domain name dispute resolution rules, the arbitration tribunal issued a final award, mandating the transfer of the domain name in question, requiring the infringing party to immediately shut down the counterfeit e-commerce website and remove all promotional materials related to the Jack Wolfskin trademark. WIPO also simultaneously reminds global brands that independent e-commerce domain names containing registered trademarks are high-frequency infringement carriers and can be quickly protected through international arbitration, without the need for litigation in multiple national courts.
