印尼最高法院近日就小鹏汽车商标抢注纠纷案作出二审反转判决,撤销印尼自然人抢先注册的 XPEV 小鹏” 汽车类商标,禁止侵权方在 TokopediaShopee 印尼站点售卖电动车配件,扫清小鹏印尼线上市场布局障碍。

案件背景显示,一名印尼自然人提前抢注小鹏汽车整车及配件商标,随后开设本土电商店铺售卖仿小鹏车载配件,借品牌知名度线上牟利,同时以商标持有人身份阻拦小鹏官方入驻印尼电商平台。一审阶段,当地法院依据印尼 “先申请先注册” 基础规则驳回小鹏维权诉求。

二审阶段,小鹏提交全球门店布局、海外宣传、国际驰名商标认定材料,印尼最高法院综合考量品牌全球知名度、抢注者无真实经营需求、刻意线上蹭流量牟利等事实,认定涉案商标属于恶意抢注,依法宣告商标注册无效,全面禁止商家使用近似标识线上经营。

知识产权律师提醒,东南亚出海品牌极易遭遇商标抢注伏击,未提前完成海外商标布局,本土电商渠道随时可能被抢注者抢占,建议企业出海同步完成多类别商标注册,持续监控本土主流电商平台仿冒店铺。

The Indonesian Supreme Court recently issued a reverse ruling in the trademark squatting dispute involving XPeng Motors, revoking the "XPEV Xiaopeng" automotive trademark preemptively registered by an Indonesian individual and prohibiting the infringing party from selling electric vehicle accessories on Tokopedia and Shopee Indonesia, thus clearing obstacles for XPeng's online market expansion in Indonesia.

The case background revealed that an Indonesian individual preemptively registered the trademark for XPeng vehicles and accessories, subsequently opening a local e-commerce store to sell counterfeit XPeng car accessories, profiting online by leveraging the brand's popularity, and simultaneously using their trademark ownership to prevent XPeng's official presence on Indonesian e-commerce platforms. In the first instance, the local court rejected XPeng's rights protection claims based on Indonesia's "first-to-file" principle.

In the second instance, XPeng submitted materials demonstrating its global store layout, overseas advertising, and international trademark recognition. The Indonesian Supreme Court, considering factors such as the brand's global reputation, the squatter's lack of genuine business needs, and the deliberate attempt to profit from online traffic, determined that the trademark in question constituted malicious squatting and declared the trademark registration invalid, comprehensively prohibiting businesses from using similar marks for online operations.

Intellectual property lawyers warn that Southeast Asian brands going global are highly vulnerable to trademark squatting attacks. Without prior overseas trademark planning, local e-commerce channels could be seized by squatters at any time. It is recommended that companies register multiple categories of trademarks simultaneously when going global and continuously monitor counterfeit stores on major local e-commerce platforms.
