本次维权由 Milwaukee 电动工具、Magnetic Bag 箱包、Messika 珠宝三大品牌联合国际维权律所发起,侵权行为高度统一:卖家未经品牌授权,在商品标题、主图、详情页完整使用品牌注册商标铺货美国市场,依靠品牌自带流量低价引流,覆盖工具、家居、配饰全品类。
法院立案后第一时间下发 TRO 临时禁令,平台同步冻结涉案店铺全部收款账户,资金无法提现。行业数据显示,Milwaukee 工具侵权案件单店平均和解金 5000 美元,整批案件合计和解金额超 890 万美元,折合人民币 6000 余万元;拒不应诉商家将直接收到缺席判决,平台全额划扣账户资金赔付品牌方,库存商品强制销毁,店铺永久封禁。

From late 2025 to December 2025, the U.S. District Court for the Northern District of Illinois accepted four trademark infringement cases, involving over 3,000 Chinese cross-border sellers on the Temu platform, making it the largest batch of trademark infringement lawsuits in the U.S. cross-border e-commerce sector in recent years.
This campaign was initiated by three brands—Milvakee power tools, Magnetic Bag handbags, and Messika jewelry—in conjunction with an international legal firm. The infringements were highly consistent: sellers, without brand authorization, used the brands' registered trademarks in their product titles, main images, and product detail pages to flood the U.S. market, relying on the brands' existing traffic to attract customers at low prices, covering all categories of tools, home goods, and accessories.
Upon accepting the cases, the court immediately issued a Temporary Responsibility Order (TRO), and the platform simultaneously froze all payment accounts of the involved stores, preventing fund withdrawals. Industry data shows that the average settlement in Milwaukee tool infringement cases is $5,000 per store, with the total settlement amount exceeding $8.9 million, equivalent to over 60 million RMB. Merchants who refuse to respond will receive a default judgment, the platform will deduct the full amount from their accounts to compensate the brand, inventory will be forcibly destroyed, and the store will be permanently banned.
Intellectual property lawyers in the industry stated that the US Lanham Act has extremely strong penalties for trademark infringement. Unintentional use of registered trademarks in titles, keywords, and product images does not constitute "uninformed exemption." Currently, Amazon, Walmart, Temu, and SHEIN have become major battlegrounds for brands to pursue bulk trademark infringement.
