海外知识产权权利人集中发起批量维权诉讼,覆盖服饰、家居、运动三大跨境热门类目,大量SHEIN和Temu等平台中国卖家卷入纠纷 Overseas Intellectual Property Rights Holders Launch Mass Infringement Lawsuits, Targeting Three Major Cross-Border Categories—Apparel, Home Goods, and Sports Products; Numerous Chinese Sellers on SHEIN and Temu Face Legal Disputes

7月14日消息,据雨果跨境,最近海外知识产权权利人集中发起多起批量维权诉讼,覆盖服饰、家居、运动三大跨境热门品类,大量SHEIN、Temu等平台的中国卖家被卷入纠纷。不少店铺面临商品下架、账户资金冻结以及高额赔偿的风险。 现在已经有好几起联邦诉讼正式立案了,涉及版权印花、潮流商标、经典插画、运动品牌标识等多类IP。 其中,俄罗斯艺术家AnnaZvereva委托律师发起的版权诉讼,针对22款原创印花图案追责,涉案店铺约400家,主要集中在印花服饰和家纺家居用品领域。

 英国潮牌Corteiz也启动了商标维权行动,重点针对平台上未经授权铺货的商家。此外,闪亮靴子青蛙插画版权案和锐步(Reebok)商标侵权案也已同步立案,维权力度明显加强。 7月2日,Reebok International Limited委托律所在美国伊利诺伊州正式发起商标维权,涉及多个Reebok文字和图形商标。Reebok的核心品类包括运动鞋、服饰、帽包等,其标志性的PUMP充气技术也是重要标识。 这次维权覆盖运动服饰、鞋履、健身器材、家纺、宠物用品等多个类目。业内建议卖家尽快自查店铺,如果发现使用Reebok相关商标的链接,应立即下架处理。 而且这类批量临时限制令(TRO)诉讼的特点是打击范围广、处罚力度大。未经授权使用印花图案、品牌LOGO或插画形象,都可能被判定侵权。 单款侵权作品的法定赔偿最高可达15万美元,平台还会直接冻结店铺回款,如果未及时应诉,店铺可能被永久封禁。 服饰和家居卖家特别容易中招,因为很多产品依赖印花图案来提升吸引力,但稍不注意就可能踩到版权红线。 上新前一定要核实图案和文字商标的版权归属,不要随意抓取外网插画或海外潮牌元素。


July 14 — According to Hugo Cross, overseas intellectual property rights holders have recently initiated multiple batch litigation actions, covering three major cross-border best-selling categories: apparel, home goods, and sporting goods. A large number of Chinese sellers on platforms such as SHEIN and Temu have been drawn into these disputes, with many stores facing risks including product delisting, account fund freezes, and substantial damages.

Several federal lawsuits have now been formally filed, involving various types of IP such as copyrighted prints, trend trademarks, classic illustrations, and sports brand logos. Among them, Russian artist Anna Zvereva, through her counsel, has filed a copyright infringement action targeting 22 original print patterns, implicating approximately 400 stores, primarily in the printed apparel and home textile/home furnishing sectors.

British streetwear brand Corteiz has also initiated trademark enforcement actions, focusing on merchants that have been unauthorizedly listing products on the platforms. In addition, the copyright case concerning the "Shiny Boots Frog" illustration and the Reebok trademark infringement case have been filed simultaneously, signaling a marked increase in enforcement intensity.

On July 2, Reebok International Limited, through its retained counsel, formally filed a trademark infringement lawsuit in the U.S. District Court for the Northern District of Illinois, involving multiple Reebok word and graphic marks. Reebok's core categories include athletic footwear, apparel, hats, bags, etc., and its iconic PUMP inflatable technology also constitutes a key identifier.

This enforcement action covers a broad range of categories, including sports apparel, footwear, fitness equipment, home textiles, pet supplies, and more. Industry insiders advise sellers to promptly conduct self-audits of their stores and immediately delist any listings found to be using Reebok-related trademarks.

Moreover, such batch Temporary Restraining Order (TRO) litigation is characterized by wide-ranging impact and severe penalties. Unauthorized use of print patterns, brand logos, or illustration designs may all be found to constitute infringement.

Statutory damages for a single infringing work can reach up to USD 150,000, and platforms may directly freeze store settlement funds. If sellers fail to respond in a timely manner, their stores may be permanently banned.

Apparel and home goods sellers are particularly vulnerable, as many products rely on print designs to enhance appeal, yet even a slight oversight may cross the copyright line.

Before launching new products, sellers must verify the copyright ownership of patterns and word trademarks, and should not arbitrarily scrape illustrations from external websites or incorporate elements from overseas trend brands.
