Specific cases include Ukrainian illustrator Viktoriia Lazareva’s copyright enforcement action concerning her game controller illustrations, which involves 394 stores across platforms such as Amazon, Walmart, and Temu.
Meanwhile, a vacuum suction phone holder developed by a Shenzhen-based Chinese company has become the subject of a patent infringement dispute in the United States, with the plaintiff having already applied for a Temporary Restraining Order (TRO). SKWRL Design has also launched enforcement actions against unauthorized sellers involving its children’s toy trademark “Feed the Fish” and related copyrights, resulting in the freezing of assets in infringing sellers’ accounts.
In addition, German footwear brand Birkenstock continues to work with law firms to pursue infringement claims against unauthorized sellers, focusing on the unauthorized use of its trademarks and graphic trademarks.
These enforcement actions highlight the critical importance of intellectual property protection in cross-border sales and serve as a reminder that sellers must strengthen their product and design infringement screening processes. Sellers should promptly remove products that may constitute infringement in order to mitigate operational risks such as litigation, account restrictions, and fund freezes.
