A group of Vietnamese individuals formed a trademark speculation group, massively registering trademarks for domestic tea beverage brands such as Heytea, Nayuki, and Gu Ming in Vietnam. After registering the trademarks, they opened online stores on Shopee and Tiki Vietnam, selling counterfeit milk tea cups, related accessories, and instant milk tea, with only minor adjustments to the logos to create visual confusion.
When domestic tea beverage brands attempted to protect their rights in Vietnam, they encountered obstacles. Vietnam operates on a "first-to-file" trademark system, and all initial legal battles were lost. Industry experts advise Chinese brands expanding overseas to simultaneously register trademarks in all categories in Vietnam, Thailand, Indonesia, and Malaysia before entering the Southeast Asian market to proactively avoid malicious trademark squatting.
