爱尔兰电商平台侵权新规:Lazada 爱尔兰站点需主动筛查商标,放任侵权将连带赔偿 New infringement rules for e-commerce platforms in Ireland: Lazada Ireland must proactively screen trademarks; failure to comply will result in joint liability for damages.

爱尔兰知识产权委员会出台跨境电商知识产权新规,落地欧盟商标条例统一标准,要求 Lazada、TikTok Shop 爱尔兰站点建立 AI 商标自动筛查系统,对上架商品标题、主图、短视频素材实时检测。

新规明确,平台若未主动筛查、收到品牌投诉 72 小时内未下架侵权商品,需与店铺商家共同承担商标侵权赔偿责任。此前爱尔兰多起判例中,平台以 “中立服务商” 免责的情况不再成立。

当地跨境服务商介绍,爱尔兰作为欧洲电商仓储中转枢纽,新规实施后海外仓、货代企业也需配合查验货物商标标识,协助拦截仿冒商品,否则一并追责。

The Irish Intellectual Property Commission has introduced new regulations on intellectual property rights in cross-border e-commerce, implementing unified standards from the EU Trademark Regulation. The regulations require Lazada and TikTok Shop's Irish sites to establish AI-powered automated trademark screening systems to monitor product titles, main images, and short video materials in real time.

The new regulations clarify that platforms that fail to proactively screen for infringing products or fail to remove infringing goods within 72 hours of receiving brand complaints will be jointly liable with the sellers for trademark infringement damages. Previous cases in Ireland where platforms were exempted from liability by claiming to be "neutral service providers" are no longer valid.

Local cross-border service providers explained that as Ireland serves as a European e-commerce warehousing and transit hub, the new regulations require overseas warehouses and freight forwarding companies to cooperate in verifying trademark markings on goods and assisting in intercepting counterfeit products; otherwise, they will also be held liable.
