Enforcement investigations revealed that infringing sellers fall into two categories: those who completely replicate the brand logo on clothing and footwear; and those who modify graphic lines and slightly adjust letter order to create counterfeit versions, relying on low prices to capture the overseas affordable sportswear market. The court ruled both types of behavior constitute trademark infringement and issued a temporary injunction freezing the stores' funds.
Industry analysis indicates that the sportswear category is the largest area for overseas brands to pursue trademark infringement lawsuits. Nike, Adidas, Reebok, and Converse have consistently filed numerous lawsuits against sellers who sell counterfeit products, and the crackdown on infringement will intensify further during peak sales seasons.
