箱包类目从业者表示,近年海外中小原创品牌商标保护意识大幅提升,小众箱包、户外包袋品牌均会批量起诉擦边铺货卖家,低价铺货模式风险激增。
JISSOE, a US-registered luggage brand, has launched a platform-wide trademark infringement lawsuit against numerous sellers on Amazon, Temu, and independent websites who use similar spellings and logos. The brand holds a US federal trademark registration in Class 18 for luggage, and many sellers have been altering one or two letters to create similar trademarks, deliberately inserting the keyword "JISSOE" into product titles to attract traffic.
The court ruled that altering only a few letters, with a high degree of similarity in pronunciation and visual appearance, is sufficient to cause confusion among overseas consumers and constitutes trademark infringement. There is no room for "changing the words to comply with regulations." This lawsuit covers over 300 cross-border luggage stores, with platforms forcibly removing all similar listings. Merchants are required to pay for the brand's economic losses and legal fees.
Industry professionals in the luggage category stated that in recent years, overseas small and medium-sized original brands have significantly increased their awareness of trademark protection. Niche luggage and outdoor bag brands are now filing mass lawsuits against sellers who use similar trademarks, leading to a surge in risks associated with low-price product listings.
